The Cassation Court returned the case against former Rosgvardiya employees Aslan Dukayev and Bekhan Abdurashidov to the Supreme Court of Chechnya. Court representatives in Chechnya ignore the arguments of the victim's side and the prosecutor's office, as well as the instructions of the higher court, emphasized the cassation instance.

As reported by "Caucasian Knot", in the summer of 2023, the Gudermes City Court of Chechnya found former Rosgvardiya employees Bekhan Abdurashidov and Aslan Dukayev guilty of the illegal detention of Alexey Kardashov. They were sentenced to two years probation for exceeding official authority. This sentence was overturned on appeal, and in June 2024, the Sheikh-Mansurovsky Court terminated the case against Abdurashidov and Dukayev due to the expiration of the statute of limitations for criminal prosecution.

The Fifth Cassation Court of General Jurisdiction overturned the appellate ruling of the Supreme Court of the Chechen Republic regarding the two former Rosgvardiya employees Aslan Dukayev and Bekhan Abdurashidov. The criminal case will be reviewed again in the appellate instance, the Anti-Torture Team reported today.

"The cassation court again pointed out that in the appeal, the courts ignore its instructions and do not pay attention to the arguments presented by the representatives of the victim and the prosecutor's office in their procedural documents. In particular, the court violated the rule against the repeated participation of a judge in the consideration of a criminal case. The judge who considered the case of the law enforcement officers had previously participated in the case of Said Omarov," commented the Anti-Torture Team in its Telegram channel on the court's decision.

As indicated in the case card on the website of the Fifth Appellate Court located in Pyatigorsk, the decision on the case was made on August 25 by Judge Timur Kuadje. One session was required for the decision. The complaint against the sentence was accepted by the court on July 1.

Rosgvardiya officer Bekhan Abdurashidov participates as a witness in the case against taxi driver Said-Magomed Omarov, accused of murdering Dagestani resident, pharmacist Alexey Kardashov. At a session in the Gudermes City Court, which is considering the case of Grozny resident Omarov after the previously issued guilty verdict was overturned for the second time, Abdurashidov, citing a concussion from participating in the SVO, requested the court to announce his earlier testimony regarding the detention of Dagestani pharmacist Alexey Kardashov. Nevertheless, in response to clarifying questions, he confirmed the testimony of Said-Magomed Omarov, which he had given before the accusation of murdering Kardashov.

It should be noted that in 2023, the Nozhai-Yurt District Court found Said-Magomed Omarov guilty of murdering Dagestani pharmacist Alexey Kardashov and sentenced him to eight years and two months in a strict regime colony. Previously, in 2020, the court sentenced Omarov to nine years in a colony for the murder of Kardashov and for stealing his car. This sentence was overturned by the Supreme Court of Chechnya. The mother of the murdered stated that Said-Magomed Omarov participated in the abduction of her son, but not in the murder. The sentence against Omarov will allow the murderers to evade responsibility, she pointed out. The Supreme Court of Chechnya in November 2024 refused to satisfy the appeal against the sentence of Omarov, convicted in the case of the murder of Dagestani resident Alexey Kardashov.

Alexey Kardashov, who owned a pharmacy in Khasavyurt, left home on September 14, 2017, and did not return; his body has not yet been found. Investigators believe that Rosgvardiya officers Bekhan Abdurashidov and Aslan Dukayev took Kardashov to Chechnya and left him with Said-Magomed Omarov, who killed Kardashov during a quarrel. The basis for the prosecution of Abdurashidov and Dukayev was the testimony of Omarov, which he gave when the investigation was conducted in Dagestan. After the case was transferred to Chechnya, he signed a confession.

The mother of Alexey Kardashov, Tsilya Yakubova, previously told a correspondent of "Caucasian Knot" that there have been no developments in the search for her son's body. "There is nothing there. Just a nightmare, they are staging their performance just like before, and nothing will happen, I know," - she said.

She also expressed outrage at the very accusation and the location of the court. "As long as this is in Chechnya, it will be like this. The lawyers are working, but it's useless. And every new mention (of her son's fate) hurts me," Yakubova lamented.

On February 24, the Gudermes Court also began considering the criminal case of former narcotics police officers Kalogi Aziev and Alikhan Yusupov, accused of illegally transporting from Dagestan to Chechnya, personally searching, and inspecting Alexey Kardashov's car in the fall of 2017. Both admitted their guilt. A witness in the case of Aziev and Yusupov, Aslan Dukayev, told the court that he remembers nothing. At the last session, Aziev and Yusupov refused to answer questions from the representatives of the victim's side.
