Court allows figurant in Dalgatov's death case to go to SMO zone

A court in Makhachkala has allowed Marat Babaev, one of the defendants in the case of the death of Kurban Dalgatov, who was detained by law enforcers, to go to the special military operation (SMO) zone.

The "Caucasian Knot" has reported that on July 4, 2024, the Investigating Committee of the Russian Federation (ICRF) announced that the investigation into the case of 11 employees of the Makhachkala police division, accused within the death case of the detained Kurban Dalgatov, had been completed. The criminal cases against two other policemen who entered into pre-trial agreements – Islam Atavov and Marat Babaev – have been separated, Madina Alieva, an advocate, who represents the interests of the casualty's family, has informed.

According to the case materials, Atavov played a "significant role" in torturing Kurbanov, Ms Alieva has added. "Babaev dealt with two other detainees; he hit them once each, but took no part in any further torture. According to witnesses, he later left the room and watched the torture of Kurban Dalgatov," the advocate has explained.

On November 5, the Sovietsky District Court of Makhachkala granted the motion of the military commissariat (registration and enlistment office) to release Marat Babaev for taking part in the SMO zone in Ukraine. The victims' relatives were outraged by this decision, the "Chernovik" outlet reports.

"Babaev signed an agreement with the court and promised to give truthful testimonies against his former colleagues and to tell how Dalgatov was killed, as well as how Dalgatov's friends were also tortured, in which Babaev personally took part, as follows from the victims' testimonies and to which Babaev had himself confessed. But we see that Babaev tried in every possible way to avoid punishment," the above outlet has quoted one of the casualty's relative as saying.

The arrested persons, with the exception of those involved in cases of treason, terrorism, extremism and fakes about the Russian Army, have chances to sign contracts with the Russian Ministry of Defence (MoD) and end up in the SMO zone, while their criminal prosecution is immediately terminated. This has already led to an "impunity conveyor belt," human rights defenders have pointed out.
