Mothers of Bodrov and Nosik who perished in North Ossetia apply to the European Court

The "Echo Moskvy" Radio reports that the advocate of the mothers of film director Sergey Bodrov and actor Timofey Nosik who perished at a gletcher landslide in Karmadon Gorge in North Ossetia, has filed a complaint to the European Court of Human Rights.

"I've filed a complaint to the European Court of Human Rights, in which I indicate that three Articles of the European Convention on Human Rights were violated in relation to mothers of Sergey Bodrov and Timofey Nosik," Igor Trunov, who is representing the interests of the victims, has reported to the RIA "Novosti."

In particular, the advocate has explained that the point was a violation of the Article of the European Convention that guarantees the right to live. "The duties of the federal authorities include notification about threats and dangers in the mountains. The pulsing Kolka gletcher is permanently sliding down, and the authorities knew it," the advocate has stated. He reminded that for the first time the gletcher went down in 1832, and then in 1902 and 1969. "Any construction in such zones should be forbidden, but it was not done," the lawyer has asserted.

Besides, the complaint indicates a violation of Article 6 of the Convention - on the right for fair trial, the "Interfax" reports. The defender has reminded that last June the Tverskoy Court of Moscow had rejected mothers' claims, and last September the Moscow City Court upheld the decision. "Moreover, the judge of the District Court refused to summon the witnesses and experts involved in the case to the trial," the lawyer has noted.

Also, Mr Trunov believes that in relation to the victims of the accident in Karmadon Gorge, the right to effective means of legal defence, fixed in Article 13 of the Convention, was breached. Mr Trunov asserts that until now no adequate investigation of the incident has been conducted.

We remind you that Sergey Bodrov and Timofey Nosik were lost on September 20, 2002, in Karmadon Gorge of North Ossetia during Kolka gletcher avalanche. During the first weeks after the tragedy, bodies of 20 persons were found by rescuers. 105 persons, including the film group of Sergey Bodrov-junior, are still regarded as missing persons. It was supposed that they could hide in Karmadon Tunnel, however when rescuers managed to make their way through the ice, they found nothing in the tunnel.
